Henderson, KY City Ordinance
Type of Law: Partial. Most enclosed public spaces, most places of employment with the exception of charitable gaming events in licensed charitable gaming facilities, outdoor arenas and stadiums, and bars.
Where Smoking is Not Prohibited: Bars, provided that the area must: (a) be fully enclosed and physically separated and that any doors in the walls or enclosure shall be closed at all times except when used for entering or exiting the area; (b) have a heating, ventilating, and air conditioning (HVAC) system which vents air directly from the separate bar area to the outside; and (c) allow no filtration of smoke from the bar area into other dining areas or other areas as the case may be within the restaurant. A bar is defined as an area devoted to the serving of alcoholic beverages for consumption by patrons on the premises and in which the serving of food is only incidental to the consumption of such beverages.
